This document explores the complex issue of “scandalizing the court” as an offence in India, tracing its colonial origins and its impact on contemporary legal and judicial practices. It critically assesses the need for reforming the offence to better align with modern democratic values and the principle of free speech. The paper argues for a redefinition of the offence to prevent its misuse, which can undermine public confidence in the judiciary, while still protecting the authority and dignity of the courts from unjustified attacks.
